1. Acceptance of terms
By accessing or using the CareGigs platform ("Service"), operated by CareGigs ("CareGigs," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Service.
We reserve the right to update or modify these Terms at any time. Your continued use of the Service after any changes constitutes acceptance of the revised Terms. We will notify users of material changes by updating the "Last updated" date on this page.
2. Service description
CareGigs is a nurse–facility matching platform that connects nursing professionals (including CNAs, LPNs, and RNs) with permanent employment opportunities at skilled nursing, long-term care, and assisted living facilities.
Our Service allows nurses to:
- Create and submit professional profiles
- Be matched with healthcare facilities that have open positions
- Receive notifications about relevant job opportunities
- Access career resources and salary information
Our Service allows healthcare facilities to:
- Post open nursing positions
- Review matched nurse profiles
- Manage recruitment pipelines
- Communicate with potential candidates through the platform
CareGigs is not an employer, staffing agency, or employment agency. We facilitate introductions between nurses and facilities, but all employment relationships are directly between the nurse and the hiring facility.
3. User accounts
To access certain features of the Service, you must create an account. You agree to:
- Provide accurate, current, and complete information during registration
- Maintain and promptly update your account information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access to your account
- Accept responsibility for all activities that occur under your account
You must be at least 18 years of age to create an account and use the Service.
4. Acceptable use
You agree not to use the Service to:
- Submit false, misleading, or fraudulent information (including credentials)
- Impersonate any person or entity
- Harass, abuse, or harm another person or entity
- Interfere with or disrupt the Service or servers/networks connected to the Service
- Attempt to gain unauthorized access to any portion of the Service or any related systems
- Use automated systems (bots, scrapers, crawlers) to access the Service
- Violate any applicable local, state, national, or international law or regulation
- Collect or store personal data about other users without their express consent
Nurses must hold valid, active credentials for the positions they seek. Submitting falsified credentials may result in immediate account termination and may be reported to relevant licensing authorities.
5. Intellectual property
The Service and its original content, features, and functionality are owned by CareGigs and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property laws.
You retain ownership of any content you submit to the Service (such as your nurse profile). By submitting content, you grant CareGigs a non-exclusive, worldwide, royalty-free license to use, display, and share your content as necessary to operate and provide the Service, including sharing your profile with healthcare facility partners.
6. Disclaimers
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
CareGigs does not warrant that:
- The Service will be uninterrupted, timely, secure, or error-free
- Any particular nurse will be matched with or hired by any facility
- Any particular facility will find suitable candidates through the Service
- The information provided through the Service (including salary data and career resources) is accurate or complete
CareGigs is not responsible for verifying the credentials of nurses or the employment practices of facilities. Healthcare facilities are responsible for conducting their own background checks, credential verification, and employment screening.
7. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, CAREGIGS, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE.
IN NO EVENT SHALL CAREGIGS'S TOTAL LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE SERVICE EXCEED THE AMOUNT YOU HAVE PAID TO CAREGIGS, IF ANY, IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
8. Indemnification
You agree to indemnify, defend, and hold harmless CareGigs and its officers, directors, employees, contractors, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorney's fees) arising out of or in any way connected with your access to or use of the Service, your violation of these Terms, or your violation of any third-party rights.
9. Governing law
These Terms shall be governed by and construed in accordance with the laws of the United States and the State of New York, without regard to its conflict of law provisions. Any disputes arising from or relating to these Terms or the Service shall be resolved in the state or federal courts located in New York.
10. Termination
We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.
Upon termination, your right to use the Service will cease immediately. You may request deletion of your account and personal data at any time by contacting us. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.
11. Severability
If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.
